Rental Agreement

In consideration of the bicycle rental services of VILLAGE BIKES INC, doing business as "Village Bikes, together with its respective agents, volunteers, participants, employees and all other persons or entities acting in any capacity on its behalf.

 

I agree as follows: 

 

1. I confirm that I am renting certain equipment from Village Bikes within the City of Richmond. In using the equipment, I shall follow all relevant laws or rules of the road ("Laws") while cycling ("Activity") and shall ensure that my children or any other persons in company with me and who rent or use the Equipment with my consent (such children or other persons being referred to as the "Others") also follow all of the Rules if participating in the Activity.

 

2. I shall be responsible for any such damage to the Equipment occurring while I or any of the Others are using the Equipment and shall fully compensate Village Bikes for any such damage. 

 

3. Behalf of myself and each of the Others, together with any respective heirs, assigns and

personal representatives of myself and the Others, as follows:

 

A. I acknowledge on behalf of myself and the Others that participation in the Activity entails unknown and unanticipated risks which could result in physical or emotional injury, paralysis, death and damage to myself, or to my children or to third parties, or to property.

 

B. I expressly agree to accept and assume all of the risks involved with the Activity.

My participation or that of any of the Others in the Activity is purely voluntary and I confirm that I and any of the Others who participate in the Activity elect to participate in spite of the risks.

 

C. I voluntarily release, forever discharge and agree to indemnify and hold harmless Village Bikes Inc from any and all claims, demands, damages, or causes of actions arising out of or in consequence of any loss, injury or damage to my person or property incurred while participating in the Activity, or relating to my use of the Equipment, including claims brought against Village Bikes Inc by third parties relating to my participation in the Activity or use of the Equipment and in all cases notwithstanding that any such loss, injury or damage may have arisen by reason of the negligent acts or omissions of Village Bikes. This release is also applicable for any of the Others, who are either my children or other persons under my care or who have obtained the Equipment rented by me with my consent.

 

D. Should Village Bikes Inc, or anyone acting on behalf of Village Bikes, be required to incur legal fees or other costs to enforce this agreement, I agree to indemnify and hold Village Bikes Inc harmless for all such fees and costs.

 

E. I certify that neither I nor any Others if participating have any medical or physical conditions which could jeopardise our safety in the Activity or the safety of others. I am willing to assume and bear the responsibility of all risks of loss or injury to person or property that may be created, directly or indirectly, by any such medical or physical condition.

 

By signing this document, I acknowledge that if any person is hurt or if any property is damaged during my participation or the participation of Others in the Activity or as a result of the Equipment rented by me, I may be found by a court of law to have waived my right to maintain a lawsuit against Village Bikes on the basis of any claim from which I have released Village Bikes herein.
